Pursuant to A.R.S. § 38-431.02, notice is hereby given to the members of the Cochise County Board of Supervisors and to the general public that the Board of Supervisors will hold a meeting open to the public for the purpose of deciding whether to go into executive session. If authorized by a majority vote of the Board, the executive session will be held immediately after the vote and will not be open to the public.

ROLL CALL
Members of the Cochise County Board of Supervisors will attend either in person or by telephone, video or internet conferencing.

The Board may permit public comment during the discussion of any item on this agenda. If you wish to be heard on a specific item, please sign up to be heard using the ‘Specific Item’ on the speaker form provided, and please list the item about which you wish to be heard. Persons will be permitted three minutes to speak.
 

Pursuant to ARS 38-431.03(B), minutes and discussions in executive session shall be kept confidential.

 
             
ACTION
 
Board of Supervisors
 
This executive session is authorized under A.R.S. § 38-431.03, Subsection (A), paragraph (3) and (4). 
 
 
1.   The County Attorney's Office will brief the Board and seek their direction on the following matters:

1. Discuss Arizona Supreme Court opinion in Solarcity Corporation, et al. v. Arizona Department of Revenue, CV-17-0231-PR/TX2014-000129 and its effect on five other tax appeal cases in which the County is a named defendant (TX2014-000189, TX2015-000240, TX2016-000876, TX2016-001025, and TX2017-000512).
 
2. Discuss and provide direction to County Attorney’s Office on whether to join the litigation in TX2014-00129 and whether to retain outside counsel, Roberta Livesay, to handle the representation. Also, discuss/provide direction concerning how to proceed in the other five tax appeal cases, including whether to retain outside counsel, Roberta Livesay, to handle the representation.   
 
3. Provide legal advice to the Board of Supervisors on the foregoing.
 
2.   Approve joining litigation CV-17-0231-PR/TX2014-000129 against Solarcity Corporation.
 
3.   Approve a contract between Cochise County and Roberta Livesay to handle the representation of the County in the Solarcity Corporation Lawsuit and the other five lawsuits involving the same corporation.
